By accessing our Site, booking an appointment, or utilizing our services, you ("Client," "you," or "your") agree to be legally bound by these Terms of Service ("Terms"). Please read them carefully before completing a booking.
1. Medical Disclaimer & Scope of Practice
The services provided by Ascend with Serina—including Reiki energy healing, sound healing, plant medicine integration, and coaching—are complementary and alternative modalities designed to support deep relaxation, stress reduction, and personal wellness.
Not Medical Care: Our services are not a substitute for professional medical diagnosis, prescription, examination, or treatment by a licensed physician, psychiatrist, or other healthcare professional.
No Diagnosis or Treatment: We do not diagnose medical or psychological conditions, prescribe any substances, or interfere with any ongoing medical treatment plan.
Client Responsibility: You are encouraged to consult a licensed healthcare professional for any physical or mental health concerns. You confirm that all health history, medical screening, and intake information provided via our booking forms is completely accurate, truthful, and up to date.
2. User Eligibility & Age Restrictions
Our services, sessions, workshops, and coaching programs are intended exclusively for adults aged 18 and older.
Age Requirement: By booking a session, utilizing our services, or interacting with our Site, you represent and warrant that you are at least eighteen (18) years of age.
No Minors Allowed: We do not knowingly accept bookings or provide services to individuals under the age of 18, even with parental or legal guardian consent.
Right to Cancel: We reserve the absolute right to immediately terminate services and cancel appointments on-site without a refund if we discover a client or participant is under 18 years of age.
3. Appointment Booking & Payment
All appointments are booked and managed through our third-party provider, Acuity Scheduling.
Payment Terms: Depending on the service type selected, different payment terms apply at checkout:
Fixed-Price Services (e.g., Reiki): A non-refundable deposit is required at checkout to secure your spot. The remaining balance must be paid on or before the day of your session. Alternatively, you may choose to pay for the service in full at checkout.
Variable-Price/Request-Based Services (e.g., Corporate Group Sessions): No payment is required at the time of booking. Your booking acts as a temporary hold request. Your request will be reviewed within twenty-four (24) to forty-eight (48) hours. Upon approval, an invoice adjusted to your specific service configuration or attendee tier will be sent separately.
Payment Processors: Payments are securely processed using our integrated third-party payment gateways (including Stripe, Square, or PayPal).
Information Accuracy: You agree to provide current, complete, and accurate purchase and account information for all bookings made through our Site.
4. Deposit, Cancellation, Rescheduling, & No-Show Policy
Your session time is reserved exclusively for you. Because we carefully prepare the space and equipment for your arrival, the following policies apply strictly and without exception:
48-Hour Notice Required: Any cancellations or requests to reschedule your appointment must be submitted at least forty-eight (48) hours prior to your scheduled session start time.
Late Cancellations & No-Shows: Cancellations made within the 48-hour window, as well as missed appointments (no-shows), are strictly non-refundable. For fixed-price services, any paid upfront deposit will be completely forfeited. Furthermore, you will remain liable for the full amount of the scheduled service, and any outstanding balances will be charged to the card on file or invoiced immediately.
5. Travel, Parking, & Space Logistics (For In-Person Services)
For all mobile, in-home, and corporate on-site sessions, the Client assumes full responsibility for providing the following conditions:
Environment: A clean, quiet, safe, and private space free from major interruptions for the duration of the healing session.
Logistics & Loading: Accessible parking and clear loading zones close to the venue entrance to allow for the safe transportation of heavy sound bowls and healing equipment.
Travel Surcharges: For locations falling outside our standard service radius (a 20-mile radius from zip code 95014), a pre-discussed travel surcharge of $1.00 per additional mile will be invoiced separately and must be paid prior to the session.
Equipment Limitations: Unless explicitly stated otherwise in writing, comfort equipment such as yoga mats, blankets, and pillows are not provided by us. The Client or host organization is solely responsible for ensuring participants bring their own materials, and we assume no liability for physical discomfort related to client-provided equipment or flooring conditions.
6. Group Size Agreements & Invoicing (Corporate & Private Events)
Group corporate sound baths and private events are priced strictly according to the specific attendee capacity tiers selected at the time of booking.
Capacity Caps & Extra Fees: Standard group bookings are subject to a strict maximum cap of twenty (20) participants. If the actual group size present on the day of the event exceeds your booked capacity tier but remains under our absolute maximum limit, an additional fee of $20 per extra participant will be applied. Group sizes exceeding 20 participants require a prior custom quote and written approval.
Invoicing: You will receive an upfront invoice based on your selected tier upon booking approval. If structural modifications or extra attendee fees are added on the day of the event, a separate retroactive invoice for this balance will be issued following the event and is due immediately upon receipt.
7. Intellectual Property
All content made available on this Site—including but not limited to text, graphics, logos, images, digital downloads, audio clips, and workshop materials—is the exclusive property of Ascend with Serina and is protected by United States and international copyright, trademark, and intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from this content without explicit written permission from us.
8. Limitation of Liability & Right of Termination
To the maximum extent permitted by applicable law, Ascend with Serina, its owners, employees, and independent contractors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from your use of our Site, any third-party conduct, or minor shifts associated with somatic energy work.
Right of Termination for Safety: We reserve the absolute right to immediately terminate any session, exit the premises, and retain full payment if the practitioner feels physically unsafe, verbally threatened, sexually harassed, or if the environment becomes hostile or unsafe. You voluntarily assume all risks associated with participating in our holistic therapies and waive any right to bring claims against us for personal injury or property damage, except in cases of proven gross negligence.
9. Indemnification
You agree to defend, indemnify, and hold harmless Ascend with Serina and its agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of your violation of these Terms or your misuse of our services.
10. Governing Law & Jurisdiction
These Terms of Service, along with your legal relationship with us, are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action arising out of these Terms shall be resolved exclusively in the state or federal courts located in Santa Clara County, California.
11. Severability & Entire Agreement
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect. These Terms constitute the entire agreement between you and Ascend with Serina regarding your use of our website and services.
